Terms of Service

1. Who we are; agreement to these Terms
These Terms of Service ("Terms") govern your use of the online training platform PhalluShape, available at phallushape.com, including the member area (the "Service"). The Service is operated by Brinvolt LLC, 30 N Gould St Ste N, Sheridan, WY 82801, United States ("Brinvolt," "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is offered exclusively to consumers who are at least 18 years old. By using the Service, you represent that you are 18 or older.
2. Language versions; users in the EU/EEA
We publish our terms in English and German. If you are a consumer whose habitual residence is in the European Economic Area, the German-language version (Allgemeine Geschäftsbedingungen), which is governed by German law, applies to you and prevails over this English version. For all other users, this English version applies. Mandatory consumer-protection laws of the country where you reside remain unaffected in either case.
3. The Service
PhalluShape is a digital training program consisting of lessons, exercise videos, a guided training plan, and a progress journal. The content conveys experience-based knowledge about manual training. It is not medical treatment, not a medical device, and not a substitute for professional medical advice, diagnosis, or care.
We make no guarantees of results. Whether and to what extent training results occur varies from person to person, and individual results may differ significantly.
4. Free account
Registration and use of the free tier (baseline assessment, the first chapter, and the progress journal) are free of charge. We may decline registrations at our discretion. A valid email address is required to register; providing your name is not required.
You are responsible for keeping your login credentials confidential. Your account is personal and may not be shared with anyone else.
5. Paid access; purchases through ClickBank
Paid access (Membership, Complete Package) is sold through Click Sales, Inc. (operating as “ClickBank”), 1444 S. Entertainment Ave., Ste. 410, Boise, Idaho 83709, USA, acting as retailer and merchant of record. Your purchase contract is formed with Click Sales, Inc., not with us. The checkout process, payment processing, invoicing, refund and cancellation rights, and the cancellation of recurring payments are governed by ClickBank's Terms of Sale, which are presented to you during checkout.
ClickBank allows the return or replacement of any product within 60 days of the purchase date, and a recurring subscription may be canceled at any time, with no further payments charged after cancellation; see ClickBank's Return and Cancellation Policy. Refunds and cancellations are handled by ClickBank, which you can reach through its customer support at clkbank.com.
After a successful purchase, we perform our part by unlocking the purchased access in your PhalluShape account, normally within a few minutes of payment confirmation.
A Membership renews as described in the checkout flow; renewals are canceled through ClickBank. When a paid period ends, your account reverts to the free tier; your journal data is retained.
6. Health and safety; assumption of risk
Training is undertaken at your own risk. Before you begin:
- If you have any pre-existing conditions, symptoms, or doubts about whether the training is suitable for you, consult a physician first.
- Complete the safety lessons in full before starting the guided training plan; the platform unlocks the plan only after you have done so.
- Stop training immediately if you experience pain, and follow the guidance in the platform's side-effects guide.
You acknowledge that physical training of any kind carries inherent risks, and you knowingly and voluntarily assume all risks associated with your use of the training content, to the fullest extent permitted by applicable law.
7. Medical disclaimer
The Service provides educational information only. Nothing in the Service creates a physician–patient relationship, and no content should be understood as medical advice for your individual situation. All content is for informational purposes only and does not replace medical advice. If you have any complaints or pre-existing conditions, consult a doctor before training.
8. License to the content
All content of the platform (text, videos, graphics, training plans) is protected by copyright and other intellectual-property laws. When access is unlocked for you, we grant you a limited, non-exclusive, non-transferable, revocable license to use the content for your personal, non-commercial purposes within the platform. You may not download, copy, reproduce, publicly display, distribute, or share the content, and you may not use it to build a competing product or to train machine-learning systems.
9. Acceptable use; suspension and termination
The following are prohibited in particular: sharing your access with others; systematically copying content; interfering with the technical infrastructure; and using the platform for any unlawful purpose. In the event of significant or repeated violations, we may suspend or terminate your account after prior notice — or, for serious violations, without notice. Any refund rights you have by law or under ClickBank's terms remain unaffected.
10. Account deletion
You may delete your account at any time using the delete function on your profile page or by emailing support@phallushape.com.
Important: Deleting your account permanently and irrevocably forfeits any purchased access (Membership, Complete Package). It cannot be restored — not even by re-registering with the same email address. We display a warning to this effect before deletion. Details on data deletion and retention periods are set out in the Privacy Policy.
11. Availability
We aim to keep the platform available at all times but do not promise any particular uptime. Maintenance, further development, or technical faults may cause temporary interruptions. Where possible, we announce longer planned interruptions in advance.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY TRAINING RESULTS WILL BE ACHIEVED.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRINVOLT AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (USD 100).
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
We accept no responsibility for training decisions made contrary to the safety instructions provided in the platform.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Brinvolt and its members, managers, employees, and agents from and against any third-party claims, damages, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms or your unlawful use of the Service. This section does not apply to you if you are a consumer in a jurisdiction that does not permit such indemnification obligations.
15. Changes to these Terms
We may update these Terms prospectively for valid reasons — for example, changes in the law or changes to the platform's features. If a change is material, we will notify you at least 30 days before it takes effect, by email or when you next log in. If you do not agree to the updated Terms, stop using the Service and delete your account before the change takes effect; your continued use after that date constitutes acceptance of the updated Terms.
16. Governing law; disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules, and excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the jurisdiction where you habitually reside remain unaffected; if you reside in the EU/EEA, Section 2 applies.
Before filing any claim, you agree to first contact us at support@phallushape.com and attempt in good faith to resolve the dispute informally within 30 days. Subject to any mandatory law giving you the right to sue elsewhere, disputes will be resolved in the state or federal courts located in Sheridan County, Wyoming, and both parties consent to the jurisdiction of those courts. Either party may bring an individual claim in small-claims court where permitted.
17. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, sale, or reorganization.
